Competition Terms & Conditions

1. Introduction - LandCruiser Giveaway

  1. These terms and conditions set out the terms on which this competition (Competition) is conducted by SHEDLIFE PRODUCTS PTY LTD ABN 66 662 103 782 trading as Shedlife (Shedlife) located at 9/9 Premier Circuit Warana 4575 (Shedlife's Business Address).   2. Information on how to enter and prizes form part of these terms and conditions. By participating, entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid. 
2. Competition Period
  1. The Competition commences and entries open at 3:00PM AEST on 19/05/2024 and ceases to be open for entry at 5:00PM AEST on 03/08/2024 (Competition Period). 
    3. Eligibility
    1. Entry is open to Australian residents over the age of 18 years that meet the requirements contained in clauses 4.1 and 4.2 (Eligible Entrants).
    2. Directors, management, employees and their immediate families, of Shedlife, retailers, suppliers, associated entities and agencies associated with this Competition are not eligible to enter.
    4. Single Entry Eligibility Shedlife.co Purchases
    1. Any shirt, hat or sticker pack purchased in the Shedlife.co store will automatically get one free entry into the competition, any Hoody purchase will automatically get two free entries. Single entries from the shedlife.co store will not count towards Shedlife Club member monthly minor prizes.
    2. Eligible items purchased in the Shedlife.co store between 3:00pm AEST on 19/05/2024 and 5:00PM AEST on 03/08/2024 will automatically be entered into the competition for the LandCruiser giveaway.
    3. An individual who submits an entry that is under the age of 18 years is not eligible to win a Weekly Minor Prize (see clause 5.3) and any such entry is deemed void. 
    4. Multiple entries are permitted subject to compliance with these terms and conditions. 
    5. Winners and Prizes
    1. The major prize consists of the following (Major Prize): 
      1. 2023 Toyota LandCruiser GXL VDJ79 with accessories valued at price of $125,000.00 (Toyota LandCruiser). This prize does not include (and the winner is therefore responsible for) insurance, registration and costs associated with obtaining any permits or licenses which may be required by the State or Territory in which the winner resides.
    2. The Prizes are not to be exchanged for another product offered by Shedlife or for money of the same value.
    3. Shedlife is not responsible or liable for any loss, damage or injury suffered by any winner as arising from, or in connection with the Prizes or the conduct of the Third-Party Suppliers.
    4. All taxes (excluding goods and services tax (GST)), which may be payable as a consequence of receiving the Prizes, are the sole responsibility of the winners.
    5. Shedlife is not liable for any loss, damage or injury suffered (even if caused by negligence) as a result of the winners accepting or using the Prize (or both), except for any liability that cannot be excluded by law.
      6. Draw Dates and Times
      1. All valid entries will be included in the draw. 
      2. The draws of Prizes will take place as follows at Shedlife's Business Address: 
        1. Toyota LandCruiser - 5:00PM AEST on 07/08/2024 (Major Prize); 
      3. The winner is determined as follows:
        1. The first valid entry drawn on the Major Prize Draw Date will be the winner of the Major Prize.
      4. The Prizes will be announced in accordance with clause 7 and 8.1. Winning is not contingent on being present at the draw.
      5. The draw will be scrutinised by an independent person, unless an exemption is granted by a regulatory authority.
        7. Prize Delivery
        1. The Winner of a Prize will be notified about how the Prize will be delivered (or may be collected) within [7] days of the draw for that Prize.
        2. A Prize will be delivered, paid or transferred to the Winner within 28 days after the Prize Draw Date for that Prize. 
        3. To effect the transfer of the Toyota LandCruiser to the respective Winner of the Major Prize, Shedlife will arrange for travel of the Winner to Shedlife's Business Address at Shedlife's cost to enable the Winner to take possession of the Major Prize or, where required by law to do so, will arrange for delivery of the Major Prize to the Winner's residential address in mainland Australia.
        8. Prize Substitution
        1. In the event that the prize (or any part of the prize) becomes unavailable for reasons beyond Shedlife's control, Shedlife may substitute a prize (or the relevant part of a prize) with a prize of equal or greater value subject to any contrary direction from a regulatory authority.
        9. Winner Notification and Publication
        1. The winner will be notified by call and email at the time of competition drawing.
        2. The name of the Winner of a Prize will be published on Shedlife's website, social media pages and additional promotional material for a minimum of 12 months.
        3. Eligible Entrants consent to Shedlife using their name, likeness, image or voice (or a combination of these) in the event that they are a Winner in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting this Competition (including any outcome) and/or promoting any products manufactured, distributed or supplied (or both) by Shedlife. 
        10. Unclaimed Prizes
        1. The prize will be distributed during or after the close of the Competition. 
        2. Shedlife will make reasonable efforts to identify and locate each Winner. 
        3. If any Prize remains unclaimed within 3 months after the applicable Prize Draw Date, an unclaimed prize draw will be held at Shedlife's Business Address on 03/11/2024 AEST subject to the approval of any necessary regulatory authority (Unclaimed Prize Draw).
        4. The Winner of an Unclaimed Prize Draw will be notified in the same manner as set out in clause 9.1. Each Winner's name will be published in the same manner as set out in clause 9.2.
        5. Shedlife assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, Shedlife may (where necessary with the approval of the relevant authority) modify, cancel, terminate or suspend the Competition.
        11. Personal Information Policy
        1. Personal information including the Eligible Entrant’s [name, address, telephone number, email and nominated bank account details] will be collected and used for the purpose of conducting this Competition. This may require disclosure to third parties, including local regulatory authorities and Shedlife’s agents or third-party service providers, for the purpose of conducting the Competition, or for promotional and marketing purposes (including for direct marketing) (Purpose).
        2. By entering this Competition, Eligible Entrant’s consent to the use of their personal information for the Purpose, and that Shedlife may contact them for future marketing and material purposes without payment. 
        3. Eligible Entrants agree that Shedlife may use this information for that purpose and disclose it to other organisations or persons that may use it, in any media for the Purpose.
        4. A copy of Shedlife’s privacy policy is available at https://shedlifeclub.com/privacy-policy/. The privacy policy contains information about how individuals may access or correct personal information or make a privacy-related complaint.
        12. Intellectual Property and Moral Rights
        1. By entering this Competition, Eligible Entrants license Shedlife to use the content of their entry in any way Shedlife wishes (including modifying, adapting, copying, publishing, broadcasting or communicating the entry whether in original or modified form in whole or in part) in all media in perpetuity without payment to the Eligible Entrant of royalties or compensation.
        2. By entering this Competition, Eligible Entrants consent to Shedlife dealing with their entry content in any way that may otherwise infringe the Eligible Entrants' moral rights and agree not to assert their moral rights (wherever such rights are recognised) in respect of their entry against Shedlife or its assigns, licensees or successors.
        3. Eligible Entrants warrant that their entry is not in breach of any third party intellectual property rights.
        13. Social Media
        1. By using and entering this Competition on Youtube, Instagram, Facebook and TikTok, Eligible Entrants:
        1. agree to comply with Youtube, Instagram, Facebook and TikTok terms of use;
        2. release Youtube, Instagram, Facebook and TikTok from all claims based on, related to or arising from the Competition; and
        3. acknowledge and agree that this Competition is in no way sponsored, endorsed, administered by or affiliated with Youtube, Instagram, Facebook and TikTok.
        4. Shedlife is not responsible for any loss, damage or injury to Eligible Entrants resulting from entering or participating in this Competition including arising from any comments made, or material published, by third parties about the Eligible Entrants on any social media platform in connection with this Competition.
        15. Jurisdiction
        1. These terms and conditions, and the trade promotion and any claim or dispute between Shedlife and an individual are governed by the laws of Queensland. Any individuals who submit an entry submit to the non-exclusive jurisdiction of courts and tribunals of Queensland in connection with any dispute concerning these terms and conditions and the trade promotion.
        16. Dispute Resolution
        1. In the event of a dispute concerning the conduct of the trade promotion or claiming a prize, individuals must contact Shedlife to attempt to resolve the dispute in good faith. If the matter cannot be resolved, either party may refer the matter to mediation administered by the Australian Commercial Disputes Centre. The costs of mediation will be shared equally between the parties.
        17. General Conditions
        1. Shedlife accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
        2. Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant's responsibility to notify Shedlife. A request to access or modify any information provided as part of the redemption of a prize should be directed to Shedlife. Shedlife takes no responsibility where it is unable to contact Winners who have not provided correct or complete contact details.
        3. Shedlife reserves the right to request verification of the social media profile of Eligible Entrants and of the age, identity and residential address of the Winners and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of Shedlife. Failure by Shedlife to enforce any of its rights does not constitute a waiver of those rights.
        4. Shedlife reserves the right to disqualify any individual who submits an entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Competition, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. In the event that a Winner breaches these terms and conditions, the Winner will forfeit the prize in whole and no substitute will be offered. Failure by Shedlife to enforce any of its rights at any stage does not constitute a waiver of those rights.
        5. The Winners have rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by Shedlife. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, Shedlife (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, without limitation:
          1. any technical difficulties or equipment malfunction (whether or not under Shedlife’s control);
          2. any theft, unauthorised access or third-party interference;
          3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Shedlife) due to any reason beyond the reasonable control of Shedlife;
          4. any variation in market value to that stated in these terms and conditions;
          5. any tax implications; or
          6. the Major Prize and Minor Prizes or use of the Major Prize and Minor Prizes.
        6. If for any reason beyond the reasonable control of Shedlife this Competition is not capable of running as planned, Shedlife reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Competition, unless to do so would be prohibited by law.
